Ma Bell Hangs Up on Dealers - Pay telephones are being removed or altered in effort to slow drug trade.

Opponents say the practice punishes law-abiding residents in high-crime areas.

Phoebe Nora's blood would boil when she used to watch the man in the sleeveless jacket work the pay telephone around the corner from her Crenshaw District home.

The routine was always the same. He would make and take a few phone calls, then slip away. When the man returned, his pockets were stuffed with drugs and the sidewalk was buzzing with customers.

"It had gotten terrible," said Nora, a determined great-grandmother who would spy on the man from her car. "He kept calling and getting more pickups. He had a wad of money that was big enough to choke a horse on."

Thanks to Nora and her neighbors, the man is now gone. Not incidentally, so is the pay telephone.

Residents in drug-plagued neighborhoods from New York City to San Diego are enlisting Ma Bell as a trenchant ally in their struggles to disconnect drug dealers who use pay phones to market their merchandise.

Authorities say many dealers prefer the curbside phones to cellular or home versions because they remain anonymous and calls are difficult to trace. The dealers, they say, essentially are using public phones as business offices. They receive phone calls from customers and call their suppliers to arrange deliveries of drugs.

At the insistence of neighborhood groups, police and an occasional politician, telephone companies have removed pay phones from troubled communities or have altered them so that they cannot receive incoming calls. In rare instances, they have even taken a technological step backward by replacing push-button dials with rotary ones to make it more difficult for dealers to use pagers activated by touch-tone signals.

"If it is necessary, we will do it," said Michael Breda of U.S. West Communications, which recently converted 18 push-button pay phones in St. Paul, Minn., to rotary dials. "We want to do anything we possibly can to curb drug trafficking."

Although telephone company officials estimate only a small fraction of the nation's 2 million pay phones have been affected by the changes, some community leaders and law enforcement agencies say the restrictions are becoming an increasingly attractive weapon in the block-by-block assault on drug dealing.

"It has been a great tool," said Sonja Richter, who organizes neighborhood crime watch groups in Seattle, where about 10% of pay phones have been limited to outgoing calls to prevent customers from calling dealers. "The dealers on the street are the lower-end ones, and they cause the greatest damage in the neighborhood. Psychologically, doing something about the phones makes people feel they have empowered themselves."

In Oakland, where an estimated 100 pay phones have been removed or altered over the past three years, police said frustrated residents have vandalized other phones in neighborhoods where they believed telephone companies were not responding quickly enough to complaints. In at least one case, drug dealers retaliated by destroying a pay phone that had been used heavily by residents, police said.

"When you are talking about neighborhood issues, you are talking about things like stop signs, why people congregate in certain areas and things like that," said Oakland police Sgt. Bob Crawford. "Phones are all part of that."

Next week a Los Angeles City Council committee is scheduled to hold a hearing on a proposed ordinance to prohibit pay phones in areas of Los Angeles where police believe their removal "would provide an overall benefit to the public by reducing the incidence of crime." Another proposal would keep the pay phones but eliminate incoming calls.

"It is time to bring some order to our neighborhoods," said Councilman Nate Holden, author of the proposal to remove the phones. "These telephones have become a real nuisance. Some of them are being used 99% of the time for drug dealing and nothing else."

Telephone company officials say they have done their best to cooperate with neighborhood groups, but many are not convinced that removing or altering pay phones is the solution to curbside drug dealing. In some cases, they say, telephone companies are being unfairly singled out by residents desperate for easy answers to deeply rooted neighborhood crime problems.

"We recognize it certainly can be a problem, but there is an element here of killing the messenger who brings the bad news," said Thomas Keane, president of the California Payphone Assn., whose members own most of the 30,000 private pay phones that have popped up statewide since regulators opened the pay phone business to competition five years ago.

"This issue was a little pebble on top of the hill a year ago, and it is now a half-blown avalanche," Keane said. "We are worried that we will get caught in, 'Let's run the pay phones off this block, and next month let's run them off another block.' "

In Washington, officials from Chesapeake & Potomac Telephone, the city's largest pay phone operator, have tried to persuade community groups that pay phones need not be removed to address complaints about drug dealing. The company recommends that phones be restricted to outgoing calls.

A company spokesman said the strategy has been motivated in part by economics. C&P removed 37 pay phones in 1988 in various Washington neighborhoods that had generated more than $120,000 a year in revenue for the company. By contrast, the company does not make money at pay phones on incoming calls, so it did not lose revenue by restricting an additional 113 phones that same year to outgoing calls.

"We strongly prefer not to just take the phones out," said C&P spokesman Michel Daley. "They are a significant form of revenue. . . . Also, pay phones are put in to meet a public need, and that is really to help people out, particularly in an emergency, anything from a flat tire to someone having a heart attack."

Paul Hirsch, spokesman for Pacific Bell, which operates 120,000 of the 200,000 pay phones in California, said the telephone company has blocked incoming calls on about 1,000 phones statewide. But he characterized the modification as a "disservice to the people in the community" who depend on phones for legitimate purposes.

"We have gotten complaints from the community asking, 'Why are you shutting us out?' " Hirsch said. "There seems to be a connection between where telephones are used by pimps and drug pushers and where telephones are used by people who might not have access to a private telephone."

Hirsch and officials from other telephone companies complain that there is no evidence that removing or altering pay phones actually reduces drug sales. In fact, Hirsch said, an informal polling of law enforcement agencies by Pacific Bell revealed that the changes to the pay phones have had little impact. At best, officials from several companies said, the restrictions have merely shifted crime problems to different neighborhoods.

"This isn't addressing the issue," said Patrick Doherty, customer service manager for GTE California.

Police from Seattle to New York said it is virtually impossible to quantify the effect of pay phone restrictions on crime, but they agreed it is highly unlikely that overall drug sales have dropped significantly because of them. They said, however, that the restrictions have had a major effect on individual neighborhoods.

"It gives drug dealers one less thing to hide behind," said Los Angeles Police Capt. Valentino Paniccia, who helped get about a dozen pay phones removed along Van Nuys Boulevard in Pacoima over the last year. "The total solution cannot be removing all of the phones in the world. But combined with other efforts, it can be very effective. Visible drug sales in this area are down 80% or 90%."

In Long Beach, where police once estimated as many as three quarters of all drug deals were arranged on pay phones, beat officers have detected an immediate drop in crime in neighborhoods where pay phones have been removed or altered. In addition to the obvious reduction in drug sales, other crimes--such as assaults, robberies and car thefts--have dropped in those areas, officers said.

"The idea is just to make it tougher for them to street deal," said Deputy Police Chief David Dusenbury.

Richter, the community organizer in Seattle, said neighborhood victories--even when they come at the expense of other neighborhoods--are important for communities that have grown weary fighting crime.

"It is a Band-Aid displacement kind of thing, but it relieves pressure," Richter said. "If you have not been able to sleep at night because of all the cars coming by, you don't care where they went. You just want to be able to sleep."

In taking on the issue, Los Angeles joins a small but growing list of municipal governments looking for ways to support police and community groups.

The City Council hearing is expected to spur debate among council members, telephone company officials and police about the effectiveness of pay phone restrictions. Several council members already have expressed reservations, saying the restrictions would punish law-abiding residents in high-crime areas.

"The answer can't always be take away the things that all the good people need because the bad people abuse them," said Councilman Joel Wachs.

In Southern California, several other cities, including Inglewood, Compton, Hawthorne, Long Beach and San Diego, have launched trial programs in recent months aimed at ridding pay phones of drug dealers.

One of the earliest government efforts came in 1987, when state and city officials in New York City teamed to restrict incoming calls on phones in drug-infested areas of Manhattan.

In January, Sacramento enacted a far-reaching law that allows the city to declare troublesome pay phones as public nuisances. The city now can remove phones if other efforts to deter drug sales--such as increased lighting and blocked incoming calls--fail.

The Sacramento ordinance also addresses an increasingly sensitive issue among pay telephone companies by prohibiting competing vendors from replacing phones that have been removed. Pacific Bell and GTE, the largest pay telephone companies in California, have complained bitterly to authorities that their private competitors have installed new phones in drug-plagued areas where the two companies have cooperated with police.

"Any time we are asked to remove a phone, and then we investigate the matter later, it is common to find a privately owned pay telephone has followed ours," said Hirsch of Pacific Bell.

In the northeast San Fernando Valley, Assemblyman Richard Katz (D-Sylmar) intervened last year to help resolve problems between GTE and several private telephone companies that had installed phones at locations where GTE had removed phones at the request of police and community groups.

Katz said some of the private telephone companies "initially did not understand the seriousness" of the problem and have since agreed to cooperate. Los Angeles Councilman Ernani Bernardi, who represents the area, characterized the private telephone companies as "scavengers" and said they have impeded efforts to clean up portions of his district.

Keane, president of the California Payphone Assn., said his members are struggling to find ways to stay in business while addressing demands from the community. In Berkeley, his company, Pay-Tel Phone System, installed flood lights around one troublesome pay phone and even turned it off during late-night hours but police still insisted that it be removed, he said.

"In our business, the value of location is very, very important," Keane said. "The best phone in the world is useless if it is in your warehouse."

One answer to the problem, Keane said, may lie in technology. New pay phones installed by private vendors, he said, can be programmed to track calls so that detailed records--similar to consumer phone bills--can be compiled for police investigations. He said the technology could act as a deterrent by making pay phones less attractive to dealers concerned about leaving a trail for police.

Keane and others say that turning back the clock by converting push-button phones to rotary dials is not the answer. Not only can dealers bypass the dials with inexpensive converters, but the rotary dials prevent legitimate callers from having access to answering machines, voice mail and other touch-tone-activated telephone services, they say.

However, Margaret McCrary, president of the Mansfield-21st Street Block Club in Los Angeles, said residents in her neighborhood want the phones removed or restricted to 911 calls. McCrary and her neighbors fought several years ago to have pay phones removed from their neighborhood. The phones are back, she said, and so are the drugs.

"Nobody relies on these phones for their livelihood or business except the drug dealers," said McCrary. "I have been in this neighborhood for 25 years. It is a nice neighborhood. We don't want the phones here."

It’s a real reversal of roles. Generally, you would think that prison guards are there to keep order amongst the prisoners and prevent violent attacks. However, it would surprise you to know that at the Orient Road Jail in Tampa, Florida, the inmates turned the tables and protected the guard from a violent attack.

When inmate Douglas Burden snapped and randomly attacked 64-year-old guard Kenneth Moon, Moon was in serious trouble. After all, he was the only guard working in his pod and since he was being strangled, he couldn’t very well call for help. Then, miracle of miracles, the prisoners in the pod came to his rescue. Four of them, in fact, swept in and pulled Burden off Moon, and the whole thing was caught on video.

These weren’t minor criminals, either. These were robbers, attempted murderers, drug traffickers, and generally bad people. The fact that they came to this guard’s rescue says good things, both about the men themselves and their capacity for mercy, and for the guard, who must’ve treated them pretty fairly for them to not turn the other cheek during this abuse.

Government Hijacks Kids TV To Propagandize For Swine Flu Shots

The federal government has accelerated its $16 million dollar PR campaign to brainwash and coerce increasingly suspicious Americans into taking the swine flu vaccine by weaving their propaganda into a popular pre-school show for children currently airing on PBS Kids.

Sid the Science Kid is a half-hour series produced by Jim Henson Productions and KCET in Los Angeles, California. The program is bankrolled in part by The Boeing Company, a titan of the military-industrial complex.

During an episode of the show set to air on Monday, the computer-generated characters are shown dancing around and singing about how their are taking their flu vaccine.

Indeed, the entire episode is devoted to pro-vaccine propaganda and was created in association with Health and Human Services. The episode is entitled, “Getting a Shot: You can do it!”

Violent UWO arrest captured on Camera

LONDON, Ont. Officials at the University of Western Ontario in this southwestern Ontario city are defending the violent arrest of a student captured on a video circulating on YouTube.

The video shows the student being held down in a campus building on Wednesday and pummelled by at least five campus and city police officers.

Officers are seen kneeing the student aggressively in the torso, beating him on the back with batons and punching him hard up to a dozen times.

At least one officer is heard yelling "Stop resisting," and then, "Give us your arm."



Elgin Austen, the head of campus police, told a news conference Thursday that by the time he arrived during the arrest, he didn't see "anything out of order" with the level of force being applied.

"It was being conducted consistent with the Ontario Police College and the training that officers have there."

He added that people seeing just the video alone "may not understand what the officers were actually doing."

"What the officers were doing was trying to apprehend a strong individual ... and not injure that person and keep other people around safe."

Austen said the incident began on the seventh and eighth floors of the social sciences building, well before the video was shot.

He said the suspect "was creating safety concerns" on the upper floors and had barricaded himself inside a room.

"Eventually, everything came down to the main floor," where efforts were made to subdue a "disoriented individual."

The student, described as about 6 foot 2 inches and more than 200 pounds, was taken to hospital for observation, then released into custody.

Charged with mischief under $5,000, assaulting a peace officer, resisting arrest and escaping lawful custody is Irnes Zeljkovic, of London.

University spokeswoman Gitta Kulczycki added that the incident needs to be kept in context. The main concern of police was protecting students and faculty, she said.

"The view of the video itself is somewhat disturbing without knowing the context of the full situation," she said.

"In terms of what were the officers trying to do let's recognize what was occurring."

Kulczycki said an automatic review is conducted in situations like these.

"We will certainly co-operate fully with London police as that occurs," she said.

Ten Swine Flu Lies Told by the Mainstream Media

The mainstream media is engaged in what we Americans call “bald faced lies” about swine flu. It seems to be true with this issue more than any other, and it became apparent to me recently when a colleague of mine — a nationally-syndicated newspaper columnist — told me their column on natural defenses for swine flu was rejected by newspapers all across the country. Many newspapers refused to run the column and, instead, ran an ad for “free vaccine clinics” in the same space.

The media, it seems, is so deeply in bed with the culture of vaccinations that they will do almost anything to keep the public misinformed. And that includes lying about swine flu vaccines.

There are ten key lies that continue to be told by the mainstream media (MSM) about swine flu and swine flu vaccines.

Lie #1 – There are no adjuvants used in the vaccines.

I was recently being interviewed by a major U.S. news network when the reporter interviewing me came up with this humdinger: There are no adjuvants being used in the swine flu vaccines, he said!

I assured him that adjuvants were, indeed, a crucial part of the vaccine recipe, and they were being widely used by drug companies to “stretch” the vaccine supply. It’s no secret. But he insisted he had been directly told by a drug company rep that no adjuvants were being used at all. And he believed them! So everything being published by this large news network about swine flu vaccines now assumes there are no adjuvants in the vaccines at all.

Lie #2 – The swine flu is more dangerous than seasonal flu

This lie is finally starting to unravel. I admit that in the early days of this pandemic, even I was concerned this could be a global killer. But after observing the very mild impact the virus was having on people in the real world, it became obvious that this was a mild flu, no more dangerous than a seasonal flu.

The MSM, however, continues to promote H1N1 swine flu as being super dangerous, driving fear into the minds of people and encouraging them to rush out and get a vaccine shot for a flu that’s really no more likely to kill them than the regular winter sniffles. Sure, the virus could still mutate into something far worse, but if it does that, the current vaccine could be rendered obsolete anyway!

Lie #3 – Vaccines protect you from swine flu

This is the biggest lie of all, and the media pushes it hard. Getting a vaccine, they insist, will protect you from the swine flu. But it’s just flat-out false. Even if the vaccine produces antibodies, that’s not the same thing as real-world immunity from a live virus, especially if the virus mutates (as they often do).

Lie #4 – Vaccines are safe

And how would any journalists actually know this? None of the vaccines have been subjected to real-world testing for any meaningful duration. The “safety” of these vaccines is nothing more than wishful thinking.

Lie #5 – The vaccine isn’t mandatory
You hear this lie all the time: The swine flu vaccine shot is voluntary, they say. But it’s not true if you’re an employee at a place where vaccines are being mandated. Millions of Americans are now being told by their employers that if they don’t get vaccine shots, they will be effectively fired from their jobs. It’s especially true with health care workers, day care employees and school teachers.

Lie #6 – Getting a vaccine shot is a good bet on your health

In reality, a vaccine shot is far more likely to harm you than help you. According to one viral expert, the actual mortality rate of the swine flu virus is estimated to be as low as .007 percent (http://www.reuters.com/article/heal…). That means H1N1 swine flu kills less than one person in 100,000. Even if the vaccine works, let’s say, 10 percent of the time, you’d have to vaccine one million people to prevent one death from swine flu.

And in vaccinating one million people, you would inevitably harm or kill several people, simply from the vaccine side effects! Your net risk of death is increased by getting a swine flu vaccine.

Lie #7 – The vaccine isn’t made with “attenuated live virus”

When the swine flu vaccines were first being announced several months ago, they were described as being made with “attenuated live virus.” This was directly mentioned in CDC documents, among other places.

This term apparently freaked out the American news consumer, and it has since been all but erased from any discussion about vaccines. Now, journalists will actually argue with you and insist the vaccines contain no attenuated live viruses whatsoever.

Except they’re wrong. The vaccines are, indeed, made with “attenuated live viruses.” That’s how you make a vaccine: You take live viruses, then you weaken them (”attenuate”) and inject them into people.

Lie #8 – Wash, wash, wash your hands (to avoid exposure)

This idea of washing your hands a hundred times a day is all based on the assumption that you can avoid exposure to the swine flu virus. But that’s impractical. The virus is now so widespread that virtually everyone is certain to be exposed to it through the air if not other means. This whole idea of avoiding exposure to the swine flu virus is nonsense. The conversation should shift to ways to survive exposure via a healthy immune system.

Of course, hand washing is a very good idea in a hospital setting. Recent news reveals that doctors are too busy to wash their own hands, resulting in the rampant spread of superbugs throughout most large hospitals in first world nations.

Lie #9 – Children are more vulnerable to swine flu than adults
This is just a flat-out lie, but it makes for good vaccine sales. Vaccines are right now being targeted primarily to schoolchildren.

But the truth is that swine flu is extremely mild in children. “It’s mildest in kids,” says Dr Marc Lipsitch of Harvard University. “That’s one of the really good pieces of news in this pandemic.” Reuters actually had the guts to report this story, but most of the larger media outlets are still reporting that children are the most vulnerable.

In too many ways, the mainstream media has become little more than a corporate mouthpiece, whoring itself out to the highest bidder / advertiser.

It’s no fault of the frontline reporters who actually work there. For the most part, they agree with what I’m saying. It’s the fault of the profit-oriented corporate mindset where news is about selling newspapers rather than actually informing the public.

Important news stories get killed every day in the newsrooms across America. They get killed not because they are poorly investigated or poorly written, but because they upset advertisers and corporate string pullers who shape the news and reject any stories that threaten their own financial interests.

Here in 2009, the distorted reporting on the swine flu vaccine has been one of the greatest media frauds ever perpetrated. The media has in every way contributed to the widespread ignorance of the American people on the subject of vitamin D and natural immune-boosting defenses that could reduce swine flu fatalities. Rather than informing readers, the MSM has made it a point to keep the people stupid, and in doing so, the media has failed its only mission and betrayed the very audience is claims to serve.

9/11 Mind Swell. Scientific evidence refutes the official story.

As we approach the eighth anniversary of 9/11 consider this paradox. In the post 9-11 years the scientific evidence for disbelieving the official government story has mounted incredibly. And the number of highly respected and credentialed professionals challenging the official story has similarly expanded. Yet, to the considerable disappointment of the international 9/11 truth movement, the objective fact is that there are no widespread, loud demands for a new government-backed 9/11 investigation. The 9/11 truth movement is the epitome of a marginalized movement, one that never goes away despite not achieving truly meaningful results, which in this case means replacing official lies with official truth. What has gone wrong?



Akin to the definition of insanity, the hallmark of entrenched but marginalized movements is that they continue to pursue exactly the same strategy and tactics that have failed to produce solid results. They indulge themselves with self-delusion, defensive thinking and acting as if the world at large must surely and finally wake up, see the light and embrace the Truth. Years and, potentially, decades go by, but this quixotic status quo remains embedded, as if set in intellectual concrete. There is no brain tumor to blame. Nor any mass hypnosis of true believers to prove. There is just monumental disinterest among the dominant culture, political establishment and the broad public that is far more engaged with other issues, problems and movements.



The 9/11 truth movement, at best, gets meager public attention when it is derided and insulted, used as an example of persistent conspiratorial insanity.



Make no mistake; I concluded a few years back, after using my professional engineering and materials science background to study the evidence, that the official government story is a lie. As a former full professor of engineering, I firmly believe that elements of the US government were involved with contributing to (not just allowing) the 9/11 tragedy, but that does not necessarily eliminate the role of those terrorists publicly blamed for the events. Science, logic, evidence and critical thinking told me this.



Who should we blame for the failure of the 9/11 truth movement to fix the historical record and, better yet, identify those in the government who turned 9/11 into an excuse for going to war, getting them indicted, prosecuted, and punished for their murderous acts?



It is too easy to blame the mainstream media and political establishment for refusing to demand and pursue a truly comprehensive and credible independent scientific and engineering investigation. President Obama with his tenacious belief in looking forward, not backward, exemplifies a national mindset to avoid the painful search for truth and justice that could produce still more public disillusionment with government and feed the belief that American democracy is weak at best, and delusional at worst.



Marginalized movements always face competition for public attention. There are always countless national issues and problems that feed new movements and distract the public. There have been many since 9/11, not the least of which was the last presidential campaign and then the painful economic recession, and now the right wing attacks on health care reform. The 9/11 truth movement illustrates a total failure to compete successfully with other events and movements.



This can be explained in several ways. The 9/11 movement has not been able to articulate enough benefits to the public from disbelieving the official government story and pursuing a new investigation. What might ordinary Americans gain? Would proof-positive of government involvement make them feel better, more secure, and more patriotic? Apparently not. In fact, just the opposite. By its very nature, the 9/11 issue threatens many things by discovering the truth: still less confidence in the US political system, government and public officials. Still more reason to ponder the incredible loss of life and national wealth in pursuing the Iraq war. In other words, revealing 9/11 truth offers the specter of a huge national bummer. Conversely, it would show the world that American democracy has integrity.



The second explanation for failure is that the truth movement itself is greatly to blame. It has been filled with nerdish, ego-centric and self-serving activists (often most interested in pushing their pet theory) unable to pursue strategies designed to face and overcome ugly, challenging realities. The truth movement became a cottage industry providing income and meaning for many individuals and groups feeding the committed with endless websites, public talks, videos, books and paraphernalia. They habitually preach to the choir. Applause substitutes for solid results. In particular, it embraces the simplistic (and obviously ineffective) belief that by revealing technical, scientific and engineering facts and evidence the public and political establishment would be compelled to see the light. Darkness has prevailed.



Proof of this are the views expressed days ago on the truth movement by Ben Cohen on the Huffington Post: “I have done some research on the topic, but stopped fairly quickly into when it dawned on me that: 1. Any alternative to the official account of what happened is so absurd it simply cannot be true. 2. No reputable scientific journal has ever taken any of the 'science' of the conspiracy seriously. 3. The evidence supporting the official story is overwhelming, whereas the 9/11 Truthers have yet to produce a shred of concrete evidence that members of the U.S. government planned the attacks in New York and Washington .” Similarly, in the London Times James Bone recently said a “gruesome assortment of conspiracy theorists insists that the attacks on the US of September 11, 2001 were an inside job. It is easy to mock this deluded gang of ageing hippies, anarchists and anti-Semites.” Truthers continue to face a very steep uphill battle.



A common lie about the truth movement is that there have been no credible scientific articles in peer reviewed journals supporting it. But those opposing the truth movement will and do find ways to attack whatever scientific evidence is produced and published. It takes more than good science and facts for the movement to succeed.



Besides the movement having too many genuine crackpots (possibly trying to subvert it), a larger problem is what has been missing from it: effective political strategies. Besides pushing scientific results and more credible supporters, it did nothing successful to make a new 9/11 investigation a visible issue in the last presidential campaign. It did nothing effective to put pressure on a new, Democrat controlled congress to consider legislation providing the authorization and funding for a new, credible investigation. It seems that people who want to blame the government are often unable to also see the political path forward that requires the government to fund a new investigation.



To its credit, Architects and Engineers for 9/11 Truth does have a petition aimed at Congress, demanding a new investigation, but has fewer than 5,000 signers. The petition effort in New York City to get a new investigation is commendable, with just under 75,000 signers, but national action is needed. Pragmatically, both efforts are unimpressive compared to other campaigns seeking political action. To get both media attention and political support the movement needs a hundred times more documented supporters, willing to do a lot more than sign a petition.



The tenth anniversary of 9/11 will come fast. The opportunity is making 9/11 an issue in the 2012 presidential campaign. The least delusional and defensive in the truth movement should think deeply and seriously on what needs to change to accomplish the prime goal: having an official investigation that compels most people and history to accept the truth, no matter how painful it is, including the possibility that it finds no compelling evidence for government involvement.

Jury say woman's disorderly-conduct arrest unwarranted

A Bucks County woman who had been robbed and left bleeding outside the Tweeter Center in Camden just didn't behave well as a crime victim, or so police thought.

Camden Detective Maurice Gibson, who alleges that Kimberly Halpin made racial slurs in describing her assailants, decided that she should be handcuffed, arrested, and jailed.

Their he-said, she-said trial landed before U.S. District Judge Renee Bumb this week. And a jury of five women and three men unanimously decided yesterday that the detective fabricated information to justify the June 19, 2004, arrest.

Halpin, 29, who is white and now works as a substance and alcohol abuse counselor, sued Camden police for false arrest after she was charged with disorderly conduct while trying to report that she had been mugged as she left an all-day music festival at the Tweeter Center.

Gibson, who is African American and has been a police officer for 16 years, said he tried to take Halpin's report, but she cried too much, was irate, cursed, and then twice used the "N-word" in describing the two assailants who took her backpack, purse, car keys, money, and cell phone.

The slur, which Halpin insists she never said, is why Halpin was locked up, Gibson testified.

Two officers in a cruiser helped her search the area for suspects, but there was no sign of anyone with her possessions.

Around midnight, the officers took Halpin to the police station on Federal Street, and told her to go inside and file a report.

Chaos ensued.

She could find no officers on the first floor as she wandered before taking the elevator to the second floor, she testified. There, she found a window, but still no police.

She pushed the buzzer, waited, buzzed, waited, and kept buzzing about every 15 seconds, she testified. She was scared and began to hyperventilate, she said, before an agitated Gibson came to the window and demanded to know her problem.

Both Gibson and Halpin testified that as she cried, she had a hard time getting her words out. He repeatedly told her to calm down and walked away when she could not. She pushed the buzzer again.

Who had robbed her, and exactly where at the Tweeter Center, and what did they look like? he wanted to know. She could not describe them, and that's where their stories part.

Halpin, her knee bleeding, said she told the detective she was hurt and wanted to use a phone, and asked if he could help her.

Gibson, frustrated with Halpin, said she couldn't articulate what happened and twice said she was knocked down by two people, using a racial slur to describe them.

Gibson said he then locked her up, fearing her words might incite others who had come to the station. Halpin, who was then a criminal justice major, said the detective locked her up because she was emotional, and accused her of making racial slurs only after she threatened to sue. At one point, she passed out in the cell, overwhelmed with emotion, she testified.

In instructing the jury before deliberation, Bumb told it that under the law, cursing or uttering racial slurs alone is not justification for a disorderly-conduct arrest. The officer had to believe that the words could lead to a disturbance to justify the arrest, the judge said.

In a questionnaire, the jury members said they believed Halpin used foul language and yelled during her interaction with Gibson, but they did not believe she made racial remarks or had been flailing her arms, as Gibson testified.

The jury decided that there was no basis for arrest and that Gibson acted maliciously. In awarding damages, however, the jury gave only $1 in compensation and $100 in punitive damages. Her attorney told the jury that Halpin was not seeking compensation. More important to her was to recognize that she was falsely arrested.

With the publication of this story, The Intelligencer has adopted the spelling Shafia for the family involved. At least four different spellings of the family’s surname have emerged in the days since the victims were discovered but this is the spelling now used in court documents and by police.

A Montreal mother, father and son accused of murdering four family members were attacked and subjected to death threats within hours of arriving at a detention centre in Napanee, the Whig-Standard has learned.

Hamed Shafia, 18, was assaulted by other inmates at the Quinte Detention Centre over the weekend when he was allowed out of his cell for yard time.

Jail staff had allowed him to exercise with other protective prisoners who were thought to be compatible.

He was not seriously hurt and did not require hospitalization.

“There was an allegation of inmate-on-inmate assault by one of these individuals,” said Stuart McGetrick, of the Ministry of Community Safety and Correctional Services.

He would not say which of the three Shafia family members filed the complaint Saturday.

McGetrick said police are now investigating.

The assault raises questions about whether three, high-profile accused mass killers can be kept safe if they are not granted bail while their complex case winds it way through the courts.

“I don’t think they’re going to be safe,” Jean-Claude Dube, the Montreal lawyer who represents Hamed Shafia, told the Whig-Standard yesterday (tues).


He did not have any firsthand information about the attack on his client.

Hamed Shafia’s father, Mohammed, was not attacked.

Tooba Mohammed Yahya, who is being held in the separate women’s section at Quinte, has not been attacked.

“It’s just a matter of time,” a prison source said.

Other inmates have been screaming threats and calling Yahya “baby killer.” She is permitted daily exercise by herself.

The two Shafia men were being held in an eight-cell wing of Quinte Detention Centre's maximum-security section known as unit 1B. They have now been moved to the jail’s segregation unit, or hole, where they are isolated from other inmates, held in single cells.

The trio arrived at Quinte last Thursday, after they appeared in court in Kingston for the first time, following their arrest Wednesday. Each is charged with four counts of first-degree murder and four counts of conspiracy to commit murder.

The parents and their oldest son are accused of scheming together to kill three other Shafia children, Zainab, 19, Sahar, 17, and Geeti, 13, along with Rona Amir Mohammed, 50.

She was Mohammed Shafia’s first wife, though he had concealed that fact since moving to Canada two years ago.

The four women were found dead June 30 inside a submerged car discovered in a lock at Kingston Mills.

“At this point, the detention centre is supposed to put them under protection … how they intend to do it I do not know,” Dube said, in an interview yesterday.

Because Quinte is so overcrowded, some protective custody inmates — those who must be isolated from others — are double or triple bunked.

Sex offenders, child killers and some other high-profile inmates are despised by the general population and could be killed if not kept isolated.

Quinte does not have a protective custody unit for women. In some cases, women who require segregation are moved into the men’s section of the facility, a practice that creates new logistical security problems.

Montreal lawyer Waice Ferdoussi, who represents Mohammed Shafia, also had not heard of the assault when he was interviewed Monday.

He said he planned to contact senior officials at Quinte.

Ferdoussi accused Kingston Police of whipping up anger at the three accused.

“They made such a huge suspicion and publicity out of this honour crime business,” he said. “This policeman from Kingston, Stephen Tanner … is saying all kinds of nonsense. He ... makes the people angry.”

At a news conference announcing the charges, Police Chief Stephen Tanner was asked about allegations by relatives of one victim that these were “honour” killings.

Tanner said it is open to speculation whether the conduct of some of the victims “was a part of a motive within the family.”

“Muslim, Afghan ... they’re presumed innocent,” Ferdoussi said.

High-profile inmates who face threats are sometimes moved back and forth between different detention centres in Ontario in a bid to reduce their visibility.

Dube said it’s problematic if they are shipped too far away. All three have separate lawyers, all based in Montreal.

“We don’t want them to be detained too far away from Kingston,” he said.

Prison sources say the trio also face a constant stream of invective because racism is rampant in the facility.

They are scheduled to appear in court again Aug. 6.

Dube and Ferdoussi said they haven’t seen any of the evidence against their clients.

“No disclosure at all,” Dube said.

A date for a bail hearing hasn’t been set.

Canadians find vast computer spy network: report.

WASHINGTON (Reuters) - Canadian researchers have uncovered a vast electronic spying operation that infiltrated computers and stole documents from government and private offices around the world, including those of the Dalai Lama, The New York Times reported on Saturday.

In a report provided to the newspaper, a team from the Munk Center for International Studies in Toronto said at least 1,295 computers in 103 countries had been breached in less than two years by the spy system, which it dubbed GhostNet.

Embassies, foreign ministries, government offices and the Dalai Lama's Tibetan exile centers in India, Brussels, London and New York were among those infiltrated, said the researchers, who have detected computer espionage in the past.

They found no evidence U.S. government offices were breached.

The researchers concluded that computers based almost exclusively in China were responsible for the intrusions, although they stopped short of saying the Chinese government was involved in the system, which they described as still active.

"We're a bit more careful about it, knowing the nuance of what happens in the subterranean realms," said Ronald Deibert, a member of the Munk research group, based at the University of Toronto.

"This could well be the CIA or the Russians. It's a murky realm that we're lifting the lid on."

A spokesman for the Chinese Consulate in New York dismissed the idea China was involved. "These are old stories and they are nonsense," the spokesman, Wenqi Gao, told the Times. "The Chinese government is opposed to and strictly forbids any cybercrime."

The Toronto researchers began their sleuthing after a request from the office of the Dalai Lama, the exiled Tibetan spiritual leader, to examine its computers for signs of malicious software, or malware.

The network they found possessed remarkable "Big Brother-style" capabilities, allowing it, among other things, to turn on the camera and audio-recording functions of infected computers for potential in-room monitoring, the report said.

The system was focused on the governments of South Asian and Southeast Asian nations as well as on the Dalai Lama, the researchers said, adding that computers at the Indian Embassy in Washington were infiltrated and a NATO computer monitored.

The report will be published in Information Warfare Monitor, an online publication linked to the Munk Center.

At the same time, two computer researchers at Cambridge University in Britain who worked on the part of the investigation related to the Tibetans are releasing an independent report, the Times said.

They do fault China and warned that other hackers could adopt similar tactics, the Times added.
